OVERVIEW

Tim Martin counsels clients in all phases of litigation and risk management. He believes that a successful litigation strategy begins with understanding his clients’ business and the motivation behind the opposing parties' arguments. Tim also understands that it is crucial to his clients to evaluate a case early on in the litigation process to maximize their goals in the most efficient manner possible. 

Tim’s practice is focused on complex civil litigation in the areas of construction, insurance coverage, toxic tort, products liability and warranty litigation, as well as representation of members of the automobile and racing industries. He has counseled a number of large companies in contract negotiations and disputes, employment matters, and asset recovery. In addition to his trial experience, Tim regularly represents clients in alternative dispute resolution proceedings, including arbitration and mediation.

  • Represented primary insurance carrier and served as Defense Liaison Counsel in a trial involving a large multi-excess carrier insurance coverage dispute involving disgorgement under New York Law and defense and indemnity obligations relating to three class action cases over delays in processing certain investment accounts
  • Won a Daubert challenge precluding a medical expert’s opinion on a future injury as speculative
  • Directed verdict at a bench trial for Plaintiff’s failure to properly support his damages calculation with proper expert testimony
  • Motion to Dismiss in a construction site accident on claims brought against a subcontractor for indemnification and contribution
  • Successfully challenged the admissibility of a liability expert’s opinion as being unreliable by attacking the foundation of the expert’s opinion
