White and Williams Wins Defense Verdict in FMLA Retaliation Lawsuit

A jury in the United States District Court for the District of Delaware returned a verdict finding that a school paraprofessional’s allegations of Family Medical Leave Act (FMLA) retaliation against a public school district were without merit. The case originally included claims for disability discrimination and retaliation under the Americans with Disabilities Act (ADA), as well as FMLA interference allegations. In pretrial motion practice all claims were dismissed except those for FMLA retaliation.

Marc Casarino and Nicholas Wynn defended the school district, and effectively demonstrated to the jury that the school district had not retaliated against the paraprofessional.
