OVERVIEW

Luciana Pecorino Lalande is Counsel with the firm's Insurance Coverage and Bad Faith Practice where she specializes in complex insurance coverage litigation and counseling. 

Luciana's clients include both domestic and international insurers in a broad range of coverage disputes arising under general liability, excess liability, umbrella liability, professional liability, employment practices liability, directors and officers, errors and omissions, specialty lines, first party property, aviation hull and hull war risk, and OCIP/CCIP insurance policies. She has extensive experience providing counsel to clients on litigation strategy and contract interpretation. Luciana represents insurers on coverage and claims handling issues in both litigated and non-litigated matters, including disputes concerning environmental, toxic tort, construction defect, sexual abuse, property damage, products liability, and professional liability exposures. She focuses much of her practice on representing and advising insurers in connection with complex and high-exposure long-tail claims, including asbestos, health hazard and pollution claims. 

While in law school, Luciana served as judicial intern for the Hon. Nicholas H. Politan, U.S.D.J., District Court of New Jersey and the Hon. Daniel P. Mecca, J.S.C., New Jersey Superior Court, Bergen County. Prior to joining White and Williams, Luciana was an attorney with several national and international law firms where she concentrated her practice in the areas of insurance coverage litigation.

REPRESENTATIVE MATTERS

  • Advises insurer clients on nationwide cutting edge issues involving climate change, PFAS ("forever chemicals") and NDMA (found in medications such as valsartan, losartan, irbesartan, and ranitidine), as well as other contemporary mass tort claims
  • Successfully obtained summary judgment in the Southern District of New York for Rectification Indemnity Coverage insurer and dismissal of bad faith claim involving underlying multi-million Ohio highway construction project
  • Counseled international hull and hull war risk insurers on various coverage issues in connection with aircraft grounded during Russian-Ukraine conflict resulting in favorable resolution
  • Obtained favorable and/or otherwise dispositive rulings for various insurer clients on key issues such as the duty to defend, "trigger" of coverage, allocation, scope of additional insured coverage, and application of policy exclusions, including pollution exclusions
