BREAKING NEWS: PA Supreme Court Amends Venue Rule for Medical Malpractice Matters

Today the Pennsylvania Supreme Court issued an Order amending PA’s rule of civil procedure pertaining to venue. The Court’s amendment eliminates the provision, put in place nearly two decades ago, which mandated that medical malpractice matters be brought only in a venue where the alleged malpractice occurred. The court took this action upon the recommendation of the Civil Procedural Rules Committee which was circulated and published for comment in December 2018. There was strong opposition to the Committee’s proposal from the healthcare community and the defense bar. Not unexpectedly, the repeal was supported by the plaintiff’s bar. The amended rule is set to go into effect on January 1, 2023. More information to follow.
