John Loughnane, Partner, recently co-authored an article published in the American Bankruptcy Institute's January 2025 Edition called, "Confidentiality Fundamentals: A Continuing Discussion," alongside Leslie A. Berkoff (Moritt Hock & Hamroff). This article follows an earlier piece which examined the fundamental importance confidentiality holds to the process of mediation, as well as the challenges advocates and party participants face due to the absence of national rulings protecting it. John and Leslie further expand on this idea throughout this article, citing recent case evidence to support it.
