Seven-Figure Settlement Reached Against Spice Ingredient Supplier

A major international food distributor incurred significant damages in the aftermath of a food recall regarding the presence of an allergen not disclosed on the packaged food label. Notwithstanding the assertion of certain legal defenses based on whether his client’s insured had standing to sue and the economic loss doctrine, Brian Tetro, a Partner in the Subrogation Department and part of the firm’s Food and Beverage practice group, secured a seven-figure settlement related to the recall. The settlement in May 2019 represented nearly 90 percent of his client’s recoverable damages.
