OVERVIEW

J. Benjamin Staherski is a partner in the Subrogation Department and practices exclusively in the field of large loss property subrogation. Ben has investigated, pursued and litigated numerous catastrophic property damage cases throughout the United States. Many of these cases include residential and commercial fire claims, water/flood damage claims and structural collapses. In pursuing these matters, he has litigated a number of cases against product manufacturers, contractors and subcontractors and utilities.

While attending college and law school, Ben obtained experience in the field of construction and HVAC while working for a family business. This experience gives him a familiarity and unique perspective in handling construction-related losses and claims against contractors and subcontractors.  

Ben is admitted to practice law in Pennsylvania, New Jersey and New York. He has also litigated cases in 16 other jurisdictions as lead counsel, with the assistance of local counsel.

In law school, Ben served as a Comments Editor for the Penn State Law Review and his comment was published in the 2004 Volume 108 issue of the Journal.

REPRESENTATIVE MATTERS

  • Obtained a recovery in excess of $1 million for the insurers of a condominium association and multiple condominium unit owners from a general contractor and subcontractor in a case involving a sprinkler discharge in Boston, MA
  • Obtained a $1.45 million recovery from a plumbing contractor for a water loss occurring at an apartment complex in Pittsburgh, PA
  • Pursuing a contribution action against an ingredient supplier who provided contaminated ingredients to the client’s insured, a food manufacturing company
  • Recovered in excess of $600,000 for a residential fire loss that occurred in NY; the recovery was made against a fireplace installer who improperly installed a flue pipe without proper clearances
  • Litigated numerous cases against manufacturers of corrugated stainless steel tubing 
  • Litigated multiple cases against manufacturers of ventilation fans
